The WaterfrontActionGroup is made up of many hundreds (soon to be

thousands) of angry and dissatisfied lease and licence holders of NSW

Government owned wetland who have suffered huge increases in rent since the

introduction and incorrect implementation of the fundamentally

flawed IPART formula in 2004/5.

Since then, WAG committee members have been working voluntarily almost non-stop. Just a few key examples of WAG's work on behalf of its members include:

  1. Full analysis of the April 2004 IPART Report and the March 2004 consultants' report to IPART, highlighting all their faults in an easy to understand format.

  2. Report by Ian Tunstall B Ec, LLB, LLM, on the IPART report, listing errors of law and valuation theory and subsequent legal advice from Mr. Tunstall.

  3. Egan National Valuers Reports on the true Net Rate of Return for Seven Sydney Harbour and Five Pittwater Precincts, plus an Egan submission to the Rate of Return Review in late 2009.

  4. Written opinions from Professor Alfred Eves, Professor of Property Economics at Queensland University of Technology, endorsing all the Egan reports.

  5. Submissions to the Reviews of the Rate of Return in late 2009, the results of which are still to be announced and which may need to be challenged legally.

  6. Appeals to Local Lands Boards, Land and Environment Court and NSW Court of Appeal

  7. Instructing and paying solicitors, barristers and expert witnesses.

  8. Consultation with property specialist lawyers, regarding a new lease document being forced on lessees by NSW Maritime and regarding claims by members for refunds of rent overpaid.

  9. WAG Area Reps personally helping members through the minefield of data when requested and providing general guidance.

  10. Setting up an extremely helpful and professional website to allow members self-help in an extremely complex issue.

  11. Provision of form letters for members to use in various situations.

  12. Liaison with the NSW Government to establish a better and fairer way forward.

  13. Continual correspondence with the two Ministers, pointing out the persistent errors in the administration of the IPART recommendations, including the rental formula, and which result in serious over-charging of our members.

  14. Six WAG Committee members, plus BOA co-opted support, devoting an extraordinary amount of time and effort for the ongoing benefit of members.

  15. Substantial submission to 2011 IPART review of rental formula.

And some of WAG's successes along the way include:

  1. Introduction of "macro-precincts" to reduce the inequities of hugely varying wetland rates between tiny precincts in each waterway.

  2. The Audit Report "Administering Domestic Waterfront Tenancies" by the NSW Auditor-General (Sept, 2009) costing the Government $168,000 - instigated by WAG.

  3. Supporting two members in appeals to the Local Lands Board, one resulting in a decision granting a 43% reduction in rent, but which WAG has now appealed, seeking a greater reduction.

  4. Supporting NSW Maritime members with claims for rent over-charges, based on the terms of their old leases, leading to substantial credits/refunds.

  5. Causing the Land and Property Management Authority to offer payment by installments.

  6. Part funding an appeal to the Land and Environment Court.

  7. Fully funding and arranging an appeal to the NSW Court of Appeal.
